We understand the interplay between Social Security claims and Montana workers’ compensation claims. Montana is one of the minority of states that is a “reverse offset” state with regard to Social Security Disability benefits. This means that the workers’ compensation insurer, and not the Social Security Administration, is entitled to an offset when a claimant is eligible for both Social Security Disability and total disability benefits from the workers’ compensation insurer.
